By using phoenixaiagent.com, our free AI tools, or engaging Phoenix AI Agent for paid services, you agree to these terms. Plain English, no fine print.

1. Who we are

Phoenix AI Agent is a digital agency founded by Sharath Kumar Peetla, based in Hyderabad, Telangana, India. We build AI-powered websites, web apps, AI agents, and 360° marketing systems for ambitious operators.

2. Free tools (chatbot, audit, quiz, strategy generator)

• Provided "as is" with no guarantees of accuracy or uptime.
• For informational purposes only — not professional consulting advice.
• You retain ownership of any URL or business detail you submit.
• We may use anonymized aggregate data to improve our tools.

3. Paid engagements

When you sign on for a paid project, a separate Statement of Work (SOW) is issued covering scope, timeline, deliverables, and price. The SOW takes precedence over these general terms. Standard terms across all our engagements:

• Fixed scope, fixed price. No hourly billing surprises.
• 50% upfront, 50% on delivery unless otherwise agreed.
• Timeline: Single Sprint 7–14 days · Full Build 4–8 weeks · Operating System retainer monthly.
• You own everything — code, designs, credentials, content — handed over on day one of delivery.
• Revisions: 2 rounds of revisions included per milestone. Additional rounds at fixed per-revision rate.
• Communication: Async-first via WhatsApp/email + weekly video checkpoints.

4. Results or refund

We're accountable to outcomes. Specifically:

• If we miss a committed deadline, we extend post-launch support 50% free as compensation.
• If you're genuinely unhappy with the work shipped, we don't cash the final invoice. We refund work not yet delivered.
• This policy excludes scope changes initiated by you mid-project, force majeure, or third-party platform delays (Google review, App Store, etc.).

5. Intellectual property

• You own all custom work delivered upon final payment.
• We retain the right to showcase the work in our portfolio (without confidential business details) unless you specifically request anonymization.
• Third-party assets (stock photos, plugins, fonts) come with their own licenses, which we ensure are paid and compliant.

6. Confidentiality

Anything you share that's marked or reasonably understood as confidential — financials, customer lists, pre-launch products — stays confidential. We sign mutual NDAs upon request before any commercial conversation.

7. Limitations of liability

To the maximum extent permitted by law, our total liability for any claim related to our services is limited to the fees you paid us in the 6 months preceding the claim. We are not liable for indirect or consequential damages (lost revenue, lost data, etc.).

8. Cancellation

• You may cancel a project at any time. We refund any work not yet delivered.
• We may terminate an engagement if a payment milestone is missed by 14+ days, or if the relationship becomes untenable. We'd give written notice and a chance to cure first.

9. Governing law

These terms are governed by the laws of India. Any disputes will be resolved in the courts of Hyderabad, Telangana.

10. Updates

We may update these terms. Material changes will be announced on this page with a new effective date. Continued use means acceptance.
